This is a clear setback for U.S. crypto regulation, but 𝗻𝗼𝘁 𝗮 𝗱𝗲𝗮𝘁𝗵 𝗯𝗹𝗼𝘄 𝘁𝗼 𝗰𝗿𝘆𝗽𝘁𝗼.
CLARITY was meant to create a federal market-structure framework: separating SEC securities from CFTC digital commodities, establishing rules for exchanges and intermediaries, protecting certain developers, and reducing uncertainty around tokens and DeFi.
The bill had already passed the House in 2025 and the Senate Banking Committee in 2026. But disputes over officials’ crypto holdings, stablecoin rewards, illicit finance, DeFi and enforcement concerns prevented the 60 votes needed to move forward.
𝙉𝙚𝙖𝙧-𝙩𝙚𝙧𝙢 𝙘𝙤𝙣𝙨𝙚𝙦𝙪𝙚𝙣𝙘𝙚𝙨:
➟ 𝗠𝗼𝗿𝗲 𝘂𝗻𝗰𝗲𝗿𝘁𝗮𝗶𝗻𝘁𝘆 𝗳𝗼𝗿 𝗰𝗿𝘆𝗽𝘁𝗼 𝗯𝘂𝘀𝗶𝗻𝗲𝘀𝘀𝗲𝘀. Token issuers and DeFi projects remain exposed to SEC and potential state enforcement. ➟ 𝗜𝗻𝘀𝘁𝗶𝘁𝘂𝘁𝗶𝗼𝗻𝘀 𝗺𝗮𝘆 𝘀𝗹𝗼𝘄 𝗼𝗿 𝗱𝗲𝗹𝗮𝘆 tokenization, staking, custody, on-chain funds and other products that need clearer rules. ➟ 𝗨.𝗦. 𝗰𝗿𝘆𝗽𝘁𝗼 𝗹𝗶𝘀𝘁𝗶𝗻𝗴𝘀, 𝗶𝗻𝗳𝗿𝗮𝘀𝘁𝗿𝘂𝗰𝘁𝘂𝗿𝗲 𝗜𝗣𝗢𝘀 𝗮𝗻𝗱 𝗶𝗻𝘀𝘁𝗶𝘁𝘂𝘁𝗶𝗼𝗻𝗮𝗹 𝗲𝘅𝗽𝗮𝗻𝘀𝗶𝗼𝗻 𝗿𝗲𝗺𝗮𝗶𝗻 𝗵𝗮𝗿𝗱𝗲𝗿 than they would have been under CLARITY. ➟ Crypto-linked stocks may face additional volatility, although markets had already priced in low odds of passage. ➟ 𝗕𝗶𝘁𝗰𝗼𝗶𝗻 𝗮𝗻𝗱 𝗘𝘁𝗵𝗲𝗿𝗲𝘂𝗺 𝗮𝗿𝗲 𝗹𝗮𝗿𝗴𝗲𝗹𝘆 𝘂𝗻𝗮𝗳𝗳𝗲𝗰𝘁𝗲𝗱 𝗼𝗽𝗲𝗿𝗮𝘁𝗶𝗼𝗻𝗮𝗹𝗹𝘆. Their existing infrastructure and spot ETFs remain. ➟ 𝗦𝘁𝗮𝗯𝗹𝗲𝗰𝗼𝗶𝗻𝘀 𝗮𝗿𝗲 𝗱𝗶𝗳𝗳𝗲𝗿𝗲𝗻𝘁. The GENIUS Act is already law and provides a separate federal framework for payment stablecoins, with implementation expected to take fuller effect around January 2027.
𝙇𝙤𝙣𝙜-𝙩𝙚𝙧𝙢 𝙘𝙤𝙣𝙨𝙚𝙦𝙪𝙚𝙣𝙘𝙚𝙨: ➟ 𝗧𝗵𝗲 𝗨.𝗦. 𝗿𝗲𝗺𝗮𝗶𝗻𝘀 𝘀𝘁𝘂𝗰𝗸 𝘄𝗶𝘁𝗵 𝗳𝗿𝗮𝗴𝗺𝗲𝗻𝘁𝗲𝗱, 𝗮𝗴𝗲𝗻𝗰𝘆-𝗯𝘆-𝗮𝗴𝗲𝗻𝗰𝘆 𝗿𝗲𝗴𝘂𝗹𝗮𝘁𝗶𝗼𝗻, while jurisdictions such as the EU continue operating under clearer frameworks like MiCA. ➟ Capital and some crypto businesses could increasingly favor jurisdictions offering greater regulatory certainty. ➟ 𝗗𝗲𝘃𝗲𝗹𝗼𝗽𝗲𝗿 𝗽𝗿𝗼𝘁𝗲𝗰𝘁𝗶𝗼𝗻𝘀 𝗿𝗲𝗺𝗮𝗶𝗻 𝘂𝗻𝗿𝗲𝘀𝗼𝗹𝘃𝗲𝗱, keeping legal risk elevated for non-custodial and open-source projects. ➟ But 𝗪𝗮𝗹𝗹 𝗦𝘁𝗿𝗲𝗲𝘁’𝘀 𝗰𝗿𝘆𝗽𝘁𝗼 𝗯𝘂𝗶𝗹𝗱-𝗼𝘂𝘁 𝗶𝘀 𝘂𝗻𝗹𝗶𝗸𝗲𝗹𝘆 𝘁𝗼 𝘀𝘁𝗼𝗽. Institutional interest in tokenization, stablecoins and on-chain finance is driven by commercial opportunity, not one bill. ➟ 𝗧𝗵𝗲 𝗡𝗼𝘃𝗲𝗺𝗯𝗲𝗿 𝗺𝗶𝗱𝘁𝗲𝗿𝗺𝘀 𝗮𝗿𝗲 𝗻𝗼𝘄 𝘁𝗵𝗲 𝗸𝗲𝘆 𝗽𝗼𝗹𝗶𝘁𝗶𝗰𝗮𝗹 𝗿𝗲𝘀𝗲𝘁. A new Congress in January 2027 could revive market-structure legislation, either along CLARITY’s lines or in a more restrictive form.
Until then, watch 𝗦𝗘𝗖 𝗿𝘂𝗹𝗲𝗺𝗮𝗸𝗶𝗻𝗴, 𝗖𝗙𝗧𝗖 𝗰𝗼𝗺𝗺𝗼𝗱𝗶𝘁𝘆 𝘁𝗿𝗲𝗮𝘁𝗺𝗲𝗻𝘁, 𝗚𝗘𝗡𝗜𝗨𝗦 𝗶𝗺𝗽𝗹𝗲𝗺𝗲𝗻𝘁𝗮𝘁𝗶𝗼𝗻 𝗮𝗻𝗱 𝗻𝗲𝘄 𝗲𝗻𝗳𝗼𝗿𝗰𝗲𝗺𝗲𝗻𝘁 𝗰𝗮𝘀𝗲𝘀. Those actions may shape crypto’s practical rules before Congress does.
𝙏𝙝𝙚 𝙗𝙤𝙩𝙩𝙤𝙢 𝙡𝙞𝙣𝙚 𝗖𝗟𝗔𝗥𝗜𝗧𝗬’𝘀 𝗿𝗲𝗷𝗲𝗰𝘁𝗶𝗼𝗻 𝗺𝗲𝗮𝗻𝘀 𝘀𝗹𝗼𝘄𝗲𝗿 𝗶𝗻𝘀𝘁𝗶𝘁𝘂𝘁𝗶𝗼𝗻𝗮𝗹 𝗮𝗱𝗼𝗽𝘁𝗶𝗼𝗻, 𝗵𝗶𝗴𝗵𝗲𝗿 𝗹𝗲𝗴𝗮𝗹 𝗰𝗼𝘀𝘁𝘀 𝗮𝗻𝗱 𝗺𝗼𝗿𝗲 𝗿𝗲𝗴𝘂𝗹𝗮𝘁𝗼𝗿𝘆 𝘂𝗻𝗰𝗲𝗿𝘁𝗮𝗶𝗻𝘁𝘆 𝗶𝗻 𝘁𝗵𝗲 𝗨.𝗦.
It does not stop Bitcoin, Ethereum, stablecoins, DeFi or blockchain development.
Crypto has survived without regulatory clarity for years. What changes now is 𝘁𝗵𝗲 𝗰𝗼𝘀𝘁 𝗮𝗻𝗱 𝘀𝗽𝗲𝗲𝗱 𝗼𝗳 𝘀𝗰𝗮𝗹𝗶𝗻𝗴 𝗶𝘁 𝗶𝗻𝘀𝗶𝗱𝗲 𝘁𝗵𝗲 𝗨𝗻𝗶𝘁𝗲𝗱 𝗦𝘁𝗮𝘁𝗲𝘀.
