Petit topo des amendements concernant les investisseurs et entrepreneurs, adoptés ou rejetés par la commission des finances dans le cadre du budget 2027.
💰 Concernant la flat tax (PFU) :
Les amendements qui visaient à augmenter la flat tax ont presque tous été rejetés. ❌
(Il en reste un seul qui devrait normalement être voté aujourd’hui, mais celui-ci n’a presque aucune chance d’être adopté.)
Les tentatives de suppression du PFU ont également été rejetées. ❌
🌍 Concernant l’Exit Tax :
Tous les amendements qui demandaient son durcissement, notamment en portant la durée de 2 à 15 ans, ont été rejetés. ❌
₿ Concernant les cryptomonnaies :
L’amendement qui propose d’intégrer les cryptomonnaies dans le champ de l’Exit Tax pour les portefeuilles dépassant 800 000€ a été adopté. ✅
L’amendement qui propose de taxer les plus-values lors de conversions de cryptomonnaies en stablecoins a également été adopté. ✅
L’amendement qui propose de rendre obligatoire la déclaration au fisc des portefeuilles crypto autohébergés (Ledger, etc.) dès 100 000€ de détention, avec une amende pouvant atteindre 10 000€ en cas de non-déclaration, a été adopté. ✅
🏢 Concernant les holdings patrimoniales :
L’amendement qui proposait d’élargir la taxe sur les holdings aux placements financiers (actions cotées, liquidités, etc.), avec un taux de 2%, a été retiré. ❌
L’amendement I-CF1440, qui proposait de supprimer la taxe sur certains actifs non professionnels des holdings patrimoniales, n’a pas été soutenu. ❌
📊 Concernant l’apport-cession (150-0 B ter) :
L’amendement porté par le rapporteur général du budget, Philippe Juvin, a été adopté. ✅
Il prévoit notamment un encadrement plus strict des donations de titres de holding et des modifications du régime de report d’imposition, avec des dispositions transitoires pour les apports antérieurs au 7 octobre 2026.
Vous l’aurez donc compris, jusqu’ici, les plus grands perdants sont principalement les détenteurs de crypto.
⚠️ IMPORTANT : tous ces résultats concernent uniquement la commission des finances.
Rien n’est encore définitivement adopté.
Les amendements devront franchir les prochaines étapes parlementaires, notamment l’examen en séance publique.
Par ailleurs, les amendements rejetés en commission peuvent revenir sur la table lors des séances publiques.
Le gouvernement pourra également faire passer sa copie initiale du budget via un 49.3 ou via des ordonnances.
