The CLARITY Act is stalled, but the Senate vote didn’t kill it.
49 senators voted to advance it, 50 opposed, while 60 votes were needed.
The key detail: Thom Tillis voted against it procedurally so he could file a motion to reconsider, keeping another vote possible.
But the problem is the 11-vote gap.
All 49 votes came from Republicans. Zero Democrats supported advancing the bill, despite months of negotiations and 126 substantive changes made to address Democratic demands.
That makes the next phase less about crypto definitions and more about finding bipartisan agreement on ethics, stablecoins, enforcement, self-custody and developer protections.
The clock is also tight.
CLARITY needs 60 Senate votes and still has to clear both chambers before the congressional session ends.
Crypto needs regulation that can actually become law, not just another bill stuck in negotiation.
