The Senate voted 49–50 on the procedural motion to advance the bill, falling short of the 60 votes required and this matters for crypto far beyond just one piece of legislation.
The CLARITY Act was designed to finally establish clearer rules for who regulates what in crypto, particularly the line between the SEC and CFTC.
In simple terms:
SEC → securities CFTC → digital commodities
That distinction is important because one of crypto’s biggest problems in the U.S. has been regulatory uncertainty.
What exactly is a token?
When does a token become a security?
When can a network or asset be treated as a digital commodity?
Who regulates an exchange?
What happens with DeFi, brokers, developers and token issuers?
CLARITY was an attempt to put those questions into an actual statutory framework rather than leaving the industry to figure them out through enforcement actions and regulatory interpretation.
But the bill ran into a political wall.
Democrats raised concerns around ethics provisions, money laundering/national security safeguards and whether regulators—particularly the CFTC—would have enough resources to implement the framework.
Republicans argued that substantial changes had already been made during negotiations and that the bill represented a bipartisan framework for giving the industry clearer rules.
The result:
49–50.
The bill did not advance.
Importantly, this was a procedural vote, not a final vote declaring the bill permanently dead. Senator Thom Tillis also entered a motion to reconsider, leaving a possible route for the legislation to return.
But the immediate consequence is obvious:
The U.S. still doesn’t have the comprehensive crypto market-structure framework the industry has been waiting for.
And that creates an interesting second-order effect.
If Congress can’t provide the clarity, attention shifts back toward the SEC and CFTC.
It also puts more importance on areas like:
• DeFi • Perpetual DEXs • Tokenized stocks/RWAs • Stablecoins • Crypto exchanges • Token launches • Institutional custody
The bigger question isn’t simply whether CLARITY passes.
It’s whether the U.S. can create a regulatory framework that gives crypto businesses enough certainty to build while still addressing consumer protection, illicit finance and conflicts of interest.
For crypto, regulatory uncertainty has been one of the biggest structural problems.
The Senate vote shows that problem isn’t solved yet.
And until it is, every major development around the SEC, CFTC and Congress is going to matter.

The Digital Asset Tax Certainty Act passed Ways and Means 38–5, while the American Reserve Modernization Act cleared Financial Services 28–21, moving both toward full House votes.
- The tax bill would create clearer rules for crypto, stablecoins, mining, staking and small transaction fees.
- ARMA would establish a Strategic Bitcoin Reserve, require a 20-year minimum holding period for reserve BTC and direct Treasury and Commerce to study ways to acquire additional Bitcoin without new taxes, borrowing or deficit spending.
